By downloading, accessing, or using TheSpot ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

TheSpot is a mobile application that provides personalized place recommendations based on your mood, preferences, and location. Features include:

• AI-powered place recommendations
• Saving and organizing places into lists
• Viewing local events
• Creating and sharing curated lists
• Posting tips and reviews

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. Subscriptions and Payments

Free Tier: Basic features with limited daily searches.

Premium Subscription: Unlimited searches and access to all features.

• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Manage or cancel subscriptions in your Apple ID Account Settings
• No refunds for partial subscription periods

5. User Content

When you post tips, reviews, or create public lists, you:

• Retain ownership of your content
• Grant TheSpot a license to display and distribute your content within the App
• Are responsible for the accuracy and legality of your content
• Agree not to post content that is illegal, harmful, or violates others' rights

6. Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose
• Post false, misleading, or harmful content
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the App or its systems
• Use automated tools to scrape or collect data
• Interfere with the proper functioning of the App

7. Intellectual Property

TheSpot and its original content, features, and functionality are owned by TheSpot and are protected by copyright, trademark, and other intellectual property laws.

8. Third-Party Content

The App displays information from third-party sources (Yelp, Google, Ticketmaster). We do not guarantee the accuracy, completeness, or reliability of this information.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that:

• The App will be error-free or uninterrupted
• Recommendations will meet your expectations
• Information about places or events is accurate or current

10. Limitation of Liability

To the maximum extent permitted by law, TheSpot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Account Termination

You may delete your account at any time through the App's Settings. We may suspend or terminate accounts that violate these terms.

12. Changes to Terms

We may update these terms periodically. Continued use of the App after changes constitutes acceptance of the new terms.

13. Governing Law

These terms are governed by the laws of the United States, without regard to conflict of law principles.
